Following a 2007 New York Times investigative analysis and a 2010 report by the Government Accountability Office documenting quality and disclosure issues involving private investments in nursing facilities, Congress enacted §6101 of the Affordable Care Act (ACA) to require more comprehensive public disclosure of ownership information. Proposed rules issued in 2011 were never made final.
On February 15, 2023, as part of the Biden-Harris Administration’s comprehensive nursing home reform agenda, the Centers for Medicare & Medicaid Services (CMS) published a new set of proposed rules to implement the ACA requirement. CMS has issued an explanatory Fact Sheet and Press Release about the proposed rules. Comments are due April 14, 2023. The Center for Medicare Advocacy will be closely analyzing the proposed rules and drafting comments, which we will share.
