The Jimmo Settlement applies to:
- Skilled Nursing Facility,
- Home Health, and
- Outpatient Therapy
- Skilled maintenance therapies and nursing are covered by Medicare if the skills of a professional are required to perform or supervise the care to ensure it is safe and effective
- Improvement or potential for improvement is not necessary
- Inpatient Rehabilitation Facility/Hospital
- Claims should never be denied because patient cannot achieve complete independence in self-care or cannot be expected to return to prior level of functioning
- The only question should be: Is the care of practical value to this individual, including to adapt to current level of disability or function?
