Frequently Asked Questions

Q:  Does the Jimmo Settlement only apply to people with certain diseases, diagnoses, or conditions?

    A:  No. The Settlement applies to anyone who requires skilled services to maintain or slow deterioration (or improve), regardless of the individual’s underlying illness, disability or injury.

    Q:  Does the Jimmo Settlement apply to services provided at home or as an outpatient, or only to nursing home care?

    A:  The Agreement applies to skilled maintenance services provided in all three care settings – home health, outpatient therapy, and skilled nursing facility.

    Q:  Does the Jimmo Settlement add to the number of days Medicare will cover in a nursing home?  

    A:  No. Medicare law provides for up to 100 days of coverage per benefit period. The Jimmo Settlement is about what should be covered – it does not add to the total number of days of coverage.

     Q.  Will the Jimmo Settlement allow people to get physical therapy at home?

    Yes. Physical (and speech and occupational) therapy is covered for qualified individuals under the Medicare home health benefit. The Settlement makes it clear that “maintenance only therapy” requiring a qualified therapist can be covered.

    To me, the coding isn't the point. These are tools that provide better quality patient information. Right/left mistakes are less likely to happen. Inaccurate chronology is reduced.
