Issue: Whether the failure of the state and federal defendants to coordinate the exchange of information necessary to ensure that the beneficiaries of the Medicare Savings Program have their Medicare premiums timely paid by the Medicaid program violates the Medicare and Medicaid statutes and the Due Process Clause.
Relief sought: Declaratory and injunctive relief to correct the lack of coordination.
Status: After extensive negotiations, plaintiffs dismissed the federal defendant from the case and settled with the state defendants. Under the order signed by the court on April 23, 2010, the class was certified, the terms of the settlement agreement requiring the state to take specified actions to ensure that eligible individuals were identified and enrolled in the Medicare Savings Program were approved, and plaintiffs' claims against the state defendants were dismissed.
